Black Bear Diner Passport Program Road Trip 2021 Giveaway

NO PURCHASE NECESSARY TO ENTER OR WIN. GIVEAWAY IS OPEN TO LEGAL UNITED STATES RESIDENTS ONLY. Participation constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules. The Giveaway begins at 12:00:01 AM Eastern Standard Time (“EST”) on 6/28/2021 and ends at 11:59:59 PM EST on 8/9/21.

Eligibility: Giveaway is offered only electronically via the Internet and is open to persons who are aged 18 years and older and legal residents of the United States. Individuals employed by or otherwise associated with Black Bear Diner, their respective parent companies, affiliates, subsidiaries, divisions, independent agents, suppliers, officers and directors, advertising, promotion, and fulfillment agencies and members of their respective immediate families and persons living in the same household, (defined as spouse, parents, grandparents, grandchildren, in-laws, children and siblings and their respective spouses) whether related or not to these individuals are not eligible to participate in the Giveaway. Void where prohibited. All federal, state, and local laws and regulations apply.

How to Enter: NO PURCHASE NECESSARY. You may enter the Giveaway by posting a travel photo on Facebook, Twitter or Instagram with the hashtag #BBDRoadTrip2021. If you do not wish to enter through a social media post, you may be entered by printing your name, street address, city, state, zip, telephone number, complete email address (optional), and a copy of your photo on a 3” X 5” piece of paper and mailing to: Black Bear Diner Marketing • PO Box 991850, Redding CA 96001. Social media entries must be received by 11:59:59 PM EDT on 8/8/2021. Handwritten entries must be received by 8/8/2021. All entries become the exclusive property of the Sponsor and will not be acknowledged or returned.

Selection of Winner & Prize: One social post with the hashtag #BBDRoadTrip will be chosen randomly each week during the giveaway period defined above. Winner will be notified by direct message on the social media account through which the entry was posted. Winners will receive $100 in Bear Bucks if a physical mailing address is provided. Prize is nontransferable/non-salable. All federal, state and/or local taxes are the sole responsibility of the winner. Unclaimed prizes will not be awarded.

All decisions are final and binding. Odds of winning will be determined by the number of eligible entries received. If winner is a minor in their state of residence, winner must provide signed parental or guardian consent, in a form provided by the Sponsor, within 10 days of receipt or any prize award will be void and may be forfeited. Sponsor is not responsible for and shall not be liable for late, lost or misdirected entry mail, or unsuccessful efforts to notify winners, or unsuccessful efforts of a winner who is a minor to provide signed parental or guardian consent.

Winner agrees to allow Black Bear Diner to share their winning post and may be required to sign and return a release of liability, declaration of eligibility, and, where lawful, a publicity consent agreement, all within 10 days of acknowledged notification. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to timely return the completed and executed declaration and releases as required, prize may be forfeited and an alternate winner may be selected from remaining eligible entries. Upon prize forfeiture, no other compensation will be given. By accepting and/or using prizes, winners agree to the use of their name, voice, and/or likeness for the purpose of advertising, trade, or promotion without further compensation, unless prohibited by law. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the email account.

Conditions: By entering, each participant agrees to be bound by these Official Rules and the decisions of Sponsor, which shall be final. Sponsor, Black Bear Diner, their respective agents, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (ii) failed, incomplete, garbled, or delayed computer transmissions; (iii) any condition caused by events beyond the control of the Sponsor that may cause the Giveaway to be disrupted or corrupted; (iv) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Giveaway; or (v) any printing or typographical errors in any materials associated with the Giveaway. Sponsor reserves the right, in its sole discretion, to suspend or cancel Giveaway at any time if a computer virus, bug, tampering, unauthorized intervention, or other technical problem of any sort corrupts the administration, security, or proper play of the Giveaway. Sponsor also reserves the right to disqualify, in its sole discretion, any person tampering with the entry process, operation of the survey website, or who is otherwise in violation of the rules.

By participating in the Giveaway, each participant agrees to release and hold Sponsor and Black Bear Diner and the employees, officers, directors, shareholders, agents, representatives of each, their parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Giveaway or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.

Black Bear Diner may utilize Facebook to promote giveaway or giveaways. The Participant understands and agrees that any such promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.

Winners List and Official Rules: We should be pleased to demonstrate our giveaway is legitimate. To obtain a copy of the giveaway Winners list, a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to: Black Bear Diner Marketing • PO Box 991850, Redding CA 96001. Requests must be received no later than 8/31/2021.
